These terms cover your use of the birkly.cloud website. Birkly the software is a separate open-source project.

Who you're contracting with

This website is operated by Kekaba (CVR 46546393), c/o Keven Bayrak, Sejerslevvej 4, 6280 Højer, Denmark — see our company information page for full details.

Waitlist and pledges

Joining the waitlist does not create a contract or entitlement to any particular release date. Pledge submissions are expressions of interest unless you complete a payment.

Donations

Optional donations (one-time or monthly) are processed via Stripe Checkout. By donating you agree to Stripe’s terms for that payment. Donations support Birkly development and are not purchases of software licenses unless stated otherwise at checkout.

Donations are voluntary gifts and are non-refundable, except where required by law. Because a donation is not a purchase of goods or a specific digital service in return for payment, the EU 14-day right of withdrawal for distance contracts does not apply to it. If you believe a donation was made in error (e.g. a duplicate charge or wrong amount), contact us and we will review it in good faith.

Governing law

These terms are governed by Danish law. If you are a consumer resident in the EU, you also retain any mandatory consumer-protection rights of your country of residence. Disputes may be brought before the competent Danish courts, or you may use the EU's online dispute resolution platform at ec.europa.eu/consumers/odr.
